This policy explains how we handle personal data. We operate as the Data Controller for your account and billing information, and as a Data Processor for the content of the notices you submit for publication.

2. Roles and Responsibilities

Controller (Account Data)

LNG is the Data Controller for administrative and account-related data collected from our clients, such as names and business contact details of your staff.

Processor (Notice Content)

LNG acts as a Data Processor for the notices you submit. This is governed by our DPA. We cannot amend or delete notices once they are part of the Public Record.

3. Information We Collect

  • Identity & Contact Data: Names, job titles, business email addresses, and phone numbers.
  • HGV Specific Data: Details required for statutory notices, including Operator Name, Trading Name, Operator Licence details, and Operating Centre addresses.
  • Financial Data: Bank details for Direct Debit mandates, handled securely by our sub-processor, GoCardless.
  • Technical Data: IP addresses, access logs, and security metadata from hgv.legalnoticegateway.com.

4. How We Use Your Information

We process data for Contractual Necessity (to manage accounts and transmit notices), Legitimate Interests (to prevent fraud and maintain service records), and Legal Obligation (to comply with regulatory requests).

5. Sub-Processors and Data Sharing

To deliver our services, we share data with the following third-party sub-processors:

  • Railway Corporation: Cloud infrastructure (SOC 2 Type 2).
  • GoCardless: Secure Direct Debit processing.
  • Microsoft 365: Business communication and email.
  • OpenAI: AI-enhanced features (Enterprise agreement).
  • Publishers: Notice content transmitted for public distribution.

6. Cookies and B2B Scope

  • Cookies: The Platform uses only "Essential" cookies for authentication and security.
  • B2B Only: LNG services are strictly B2B. We do not knowingly collect personal data from individuals under 18.

7. Data Retention

  • Account Data: Retained for the duration of your account plus six (6) years for audit, tax, and contract limitation purposes.
  • Notice Content: Retained for six (6) years in line with standard statutory retention requirements.
  • Public Record: Once published, a Notice becomes a permanent part of the Public Record. LNG cannot delete data from the public domain once published.

8. Data Security and International Transfers

Your data is stored in secure environments, including GDPR-certified data centres. For transfers to the US, we rely on Standard Contractual Clauses and the Data Privacy Framework.

We regularly undertake and review our security measures to protect your data. Our team is also regularly tested, and trained to handle data securely, and we operate using a minimum-necessary data access policy. This means our teams are only provided with the minimum data access necessary to perform their roles.

9. Your Rights and the ICO

You have the right to access, correct, or request the deletion of your account data. For data contained in a published notice, these rights must be exercised through the Advertiser (Controller).

If dissatisfied, you may lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk/make-a-complaint, using our registration: ZC065412.
